NEWPORT NEWS -- A Newport News man has been arrested and charged after allegedly injuring a small dog.

Adam Battles, 35, of the 800 block of Little Dean Circle has been charged with two counts of Misdemeanor Animal Cruelty.

A neighbor at The Jamestown Apartments called police after screeching and yelping woke her up shortly before 5:00 a.m. on September 20.

"He picks it up by its neck and starts beating it into the fence about three times," the neighbor told 13News Now. "I called the cops about the time my fiance looked out the window and saw him swinging the puppy around his head."

When officers got to the home in the 100 block of Yeardley Drive, Battles' girlfriend who lives in the apartment but was at work when the alleged abuse occurred, allowed them inside the home to check on the welfare of the animals.

Police found a Chihuahua that had an injured leg. The said the owner took the dog to a veterinarian who said the puppy's leg was broken.

13News Now stopped at the address where Battles lives. No one answered the door, but someone appeared briefly in an upstairs window.

"Turns out she kicked him out, thank God, and the puppy actually has a really awesome owner," the neighbor who called 9-1-1 said. "She's a sweetheart, and that puppy is very loved, so I'm grateful for that."

Battles is due in court on October 23.
