Surry Co. prosecutor 'somewhat upset' by Vick property search

05:28 PM EDT on Saturday, June 9, 2007

13News

Two parallel investigations are underway into whether dogfighting occurred on Surry property belonging to Michael Vick, Commonwealth's Attorney Gerald Poindexter told 13News Friday.

Surry County is still considering charges in the case and Poindexter says it appears the U.S. Attorney's Office has an investigation of its own, after federal authorities conducted a search of Moonlight Road property Thursday.

Poindexter said he does not know what was found.

Poindexter did call Thursday's search "a breach of protocol" and says he found about it around the same time federal authorities began scouring the grounds for evidence.

"I was somewhat bothered by it and upset," Poindexter said. "I didn't realize the U.S. Attorney's office had any interest in running an investigation."

He says he does not know why the feds suddenly swooped in and did a search without Surry County. He questiosn whether it could be racially motivated, or if the feds are targeting the celebrity in Michael Vick.

"I just can't believe that they would've been here if it were not Michael Vick's property," Poindexter said.

He also said he and Surry Sheriff Harold Brown were preparing to file a search warrant of their own but will likely abandon those plans.

"What's the point in going back now?" Poindexter said.

He said the USDA will likely share the results of their search with Surry investigators, who are still moving forward with their own investigation.

Federal investigators from the USDA obtained a sealed search warrant in Richmond before going to the property after informants said the remains of many dogs were buried on the property behind the two-story home.

Excerpts from letter sent to Atlanta Falcon ticketholders:

This off-season has certainly presented a lot of challenges to us, and we realize it has been difficult for our fans. Therefore, we thought it would be helpful to let you know where we are as an organization.

Any time a player in our league - and especially a Falcons player - shows up in a negative light for any act, it is disappointing to us. While unsubstantiated to date, the current public situation concerning Michael

Vick puts us in a particularly difficult spot because of the daily attention it is receiving in the media, and our inability to respond because we don't yet have all the facts with which to deal.

We hope you understand it would be inappropriate and premature to make any definitive statements or take any action until we know the facts. Therefore, we are awaiting the outcome of the investigation just as you are.

For the benefit of our fans, the Falcons and Michael, we hope there will be a quick and clear resolution to this matter so we all can move forward.

Friday, WVEC.com reported information about dog remains allegedly found at the Vick property. We attributed the information to ESPN Radio. That information was not reported by ESPN and cannot be confirmed by WVEC. We regret the error.
