All cases involving Womble as an arresting officer will go forward whether Womble is fired or not, according to Commonwealth's Attorney spokeswoman Julie Pickell. Womble would still be called as a witness, she noted.
VIRGINIA BEACH -- The Virginia Beach DUI officer convicted of DUI and hit-and-run won't appeal his conviction.
Bryan Womble waived his right to appeal and reported to jail Monday afternoon to serve a five-day sentence, according to online records.
After the May crash at the Oceanfront, Womble was reassigned to desk duty pending the outcome of his criminal case and an internal investigation.
His status at the police department is unchanged, according to police spokesman MPO Adam Bernstein.
"There are still a handful of interviews left before a decision is made," he explained.
Womble is the officer who arrested NFL Hall of Famer Bruce Smith on a DUI charge.
Smith was convicted of third-offense DUI and a Circuit Court judge is scheduled to hear his appeal in January.
