VIRGINIA BEACH-- The man arrested for the double murder at a Rally's Restaurant in Virginia Beach is now facing capital murder charges.
Deandre Leon Dunnaway, 23, of the 600 block of Rivers Reach in Virginia Beach, was indicted for capital murder on Monday.
Dunnaway was also indicted for two counts of first degree murder, armed robbery and three counts of use of a firearm and conspiracy.
Dunnaway remains in custody, and his next court appearance is scheduled for April 30, 2013.
His co-defendant, 20-year-old Cheari Edwards, also of Rivers Reach, was indicted for two counts of first degree murder, three counts of use of a firearm, armed robbery, and conspiracy.
Edwards also remains in custody and is due in court on April 23, 2013.
Dunnaway and Edwards are accused of murdering a co-worker and the co-worker's brother during a robbery Rally's at 845 Lynnhaven Parkway on Jan.8, 2013.
A delivery driver called police after he saw a body inside the restaurant. Police said Alphonso White, 27, and Michael Johnson, 19, had been shot to death.
White, who was engaged to be married, recently had a son.
