RICHMOND -- The Virginia Court of Appeals has dismissed the appeal filed by Ryan Frederick, according to his attorneys.
He was sentenced to 10 years in prison for the January 2008 shooting of Chesapeake Detective Jarrod Shivers.
Shivers was shot on the night of January 17 as police executed a drug search warrant at Frederick’s home on Redstart Avenue.
Defense attorneys argued that Frederick fired in self-defense, fearing that someone was breaking into his home.
A jury found Frederick guilty of voluntary manslaughter in February 2009.
The appeal was filed with the court in September, 2009 and was denied Tuesday, according to the Va. Court of Appeals Website.
Frederick's attorneys tell 13News they'll likely appeal the decision to the Virginia Supreme Court
