Judge to rule on Va Tech lawsuit by Jan. 15

CHRISTIANSBURG, Va. (AP) — A Montgomery County Circuit Court judge will issue a decision by Jan. 15 on whether to dismiss a lawsuit filed by the families of two students slain in the mass shootings at Virginia Tech.

Judge William Alexander said in court Monday that he will spend the next month preparing a written ruling on that question as well as requests for sovereign immunity for some officials.

The families of Erin Peterson and Julia Pryde are suing the state, Virginia Tech and university and mental health officials, claiming gross negligence. Their $10 million lawsuit also names as a defendant the estate of Seung-Hui Cho (sung-wee joh), the student gunman who killed 32 people before taking his own life in April 2007.
