09:46 AM EDT on Tuesday, April 7, 2009

Reported by: Wayne Carter

A man is in critical condition after being severely beaten in a fight at a Virginia Beach night club Friday night.

The fight was the latest violent incident at Club Encore, a night spot that’s no stranger to police.

13News has learned that the city has filed an injunction to revoke the club’s ABC license due to ongoing problems at the popular night spot.

Friday night’s incident happened outside the club, located at 1889 Virginia Beach Boulevard near NAS Oceana.

Janine Hunter and her family haven't left Virginia Beach General Hospital all weekend. Their loved one Kevin Luck is in intensive care with a swollen brain after a huge bar fight Friday night.

"We thought he was brain dead. We didn't know if he was going to make it in the next 24 hours at all," said Hunter, the victim’s cousin.

Luck was at the Encore when family members say someone hit him across the head with a champagne bottle. The blow was so hard, he's been in the hospital ever since.

"The doctor said it's a life-death situation, through the prayers and mercy of God," said the victim’s aunt, Gloria Hunter.

Club Encore has become a popular hot spot in Virginia Beach, well known not just with patrons, but with police.

13News pulled police documents for Club Encore and officers went though them with us, showing numerous reports of gunshots, fights, and robberies. There have been forty calls of service in the past 3 months.

"When an establishment creates an environment where we're called out repeatedly, that's when we're going to have to give it more attention," said police spokesman Adam Bernstein.

13News has confirmed that an injunction has been filed to immediately suspend sales of alcohol at Club Encore. That means no more drinks served until police can talk to owners about a plan to keep the bad behavior from happening again.

The city has requested a hearing on Tuesday, Dec. 30, at 11 a.m. in Circuit Court.
