Update 10/25:  According to Eagle On Alliance, a motion was filed by the group in Federal Court Friday for an emergency injunction to stop the U.S. Fish and Wildlife Service from allowing the destruction bald eagle nests at Norfolk Botanical Garden.

A hearing on the motion is set for Tuesday, October 29, 2013 in United States District Court.

NORFOLK. (AP) -- An environmental advocacy group is suing the U.S. Fish and Wildlife Service to halt the removal of bald eagle nests near Norfolk International Airport.
 
Federal law says bald eagles can only be moved as a last resort to protect people or the birds. The city claims that the proximity of the eagles to the airport endangers travelers.
 
The Virginian-Pilot reports (http://bit.ly/123C1Pe ) that Eagle On Alliance filed the lawsuit Wednesday in U.S. District Court in Norfolk.
 
The group contends that the federal agency didn't require the city to pursue alternatives to removing the nests and that biologists have said destroying them wouldn't likely keep the eagles away.
 
The environmental group says it hopes to stop the destruction of the nests before the fall nesting season. The city's permit expires Oct. 31.
