UPDATE  5/6:  The case against 32-year-old Michael Brandon Hogue will not go forward. Prosecutors have agreed to "Nolle Prosequi" the case, meaning they have withdrawn it from court but reserve the right to bring the case back within a year.

Hogue tells 13News Now that he was actually the victim in the case and should never have been charged.

 

ORIGINAL STORY

GLOUCESTER COUNTY -- A man who broke into a house in Gloucester County got more than he bargained for after he was beaten up by a resident inside the home. 

Police say when 32-year-old Michael Brandon Hogue forced entry into the home in the area of Orchard Lane and Hickory Fork Road March 26, a struggle ensued between him and a male resident.  

Fearing for his life, Hogue eventually fled on foot. Police located him at a nearby residence a short time later. He was then transported to a nearby hospital to be treated.

A warrant was later obtained for Breaking and Entering with the intent to commit a Misdemeanor. Hogue is currently be held in the Gloucester County Jail without bond. 

The male resident was not injured during the ordeal. An investigation is still underway.
