RICHMOND -- A judge has refused a defense request to subpoena Virginia Attorney General Ken Cuccinelli and one of his assistants in the embezzlement case against the former chef at the governor's mansion.
 
Richmond Circuit Judge Margaret Spencer issued her order late Wednesday afternoon. Steve Benjamin, the attorney for ex-chef Todd Schneider, asked for court approval to call the Republican attorney general and assistant Patrick Dorgan to testify at a hearing Monday on a motion to dismiss the four felony charges.

Cuccinelli and the special prosecutor in the case opposed the subpoena request.
 
A defense witness list filed earlier Wednesday says Executive Mansion director Sarah Scarbrough has been subpoenaed for the hearing. No other names are on the list now that Cuccinelli and Dorgan have been excluded.
