VIRGINIA BEACH (AP) -- A Virginia Beach councilman no longer faces a domestic assault charge.
A special prosecutor agreed Wednesday to withdraw the misdemeanor charge against Councilman John Uhrin in Virginia Beach Juvenile and Domestic Relations District Court.
The Virginian-Pilot reports that Norfolk prosecutor Jill Harris cited lack of evidence. She has the right to refile the charge within one year.
"Our Office thoroughly reviewed the evidence from the State Police investigation. The evidence shows an argument took place but did not rise to the level of the charge of domestic assault," said Norfolk Commonwealth's Attorney spokeswoman Amanda Howie.
A spokeswoman for Virginia Beach Commonwealth's Attorney Harvey Bryant says Harris handled the case because Bryant and Uhrin have supported each other's political campaigns.
Uhrin was charged on Oct. 6 after a neighbor called police. Uhrin and his wife, Catherine, denied allegations that he assaulted her.
