SCC rules it cannot stop Portsmouth delay of Midtown Tunnel utility work

PORTSMOUTH--The State Corporation Commission ruled Tuesday it has no juridiction in a dispute between Portsmouth and Elizabeth River Crossings (ERC).

The ruling means the city can continue to delay utility work on the Midtown Tunnel project over the protests of ERC.

Elizabeth River Crossings had asked the SCC in June to make the city cooperate and move five utility lines maintaining that the issue was causing delays in the project. The company's petition claimed that the city had ceased all assistance in relocating lines. 

The city of Portsmouth also is involved in a lawsuit  to defeat tolls that would fund the project.

That lawsuit is scheduled for a hearing before the Virginia Supreme Court on Wednesday.
