PORTSMOUTH -- After fighting to get his name on the November ballot, Paul Smith backed out of the Portsmouth City Council Race.
The Virginian-Pilot reports that growing work commitments were a major deciding factor for Smith.
A circuit court judge ruled that Smith and another candidate Elizabeth Psimas be put on the ballot even though they missed the filing deadline in June.
The judge said that the early deadline was a mistake in the city charter.
Smith says he will now endorse Danny Meeks for the open spot.
