PORTSMOUTH -- A lawsuit against tolls to pay for a new Midtown Tunnel, improvements to the current Midtown and Downtown tunnels, and extend the Martin Luther King Freeway was filed Thursday afternoon.

The filing by attorney Pat McSweeney on behalf of Tidewater Against Unfair Tolls took place at 4:00 p.m. at Portsmouth Circuit Court.

The $2.1 billion project by the Virginia Department of Transportation and Elizabeth River Crossings partnership will be financed through tolls initially ranging from $1.59 to $1.84 per car for the tunnels and $.50 for the MLK Extension for tunnel users and $1 for non-tunnel users.

Toll collection is set to begin in January 2014.
