UPDATE 6/3: Police say Washington shot the victim during an argument and an armed security guard at the Waffle House saw the incident and confronted him.  The shooter pointed his gun at the guard, who fired once.
Washington was arrested after officers stopped a car seen leaving the restaurant.

HAMPTON -- A Hampton man is charged with shooting another man near the Waffle House early Saturday morning. 

Police say 32-year-old Nicholas Jermaine Washington shot the victim around 3 a.m.

The victim was taken from the Mercury Blvd. restaurant to the hospital with injuries that aren't life threatening, said Cpl. Mary Shackelford.

Jenkins is charged with malicious wounding, shooting in occupied dwelling, discharge firearm in public, possession of a firearm by a convicted felon and use of firearm in commission felony.
