CHESAPEAKE -- A hotel developer is under investigation for allegedly using defective building materials.

showing that, in late March, Dilip Patel was warned the Chinese drywall he was using to construct Comfort Inn on Military Highway was in code violation.

City inspectors issued a notice of violation on May 5 and gave Patel 30 days to remove the drywall. When the city's code department heard nothing, a criminal summons was issued.

City officers say Patel can avoid a court battle by removing the drywall and proving the new materials are tested and approved.
